Article (18)
Without prejudice to the provisions of the Decree-Law and to the Civil and Penal Liability, and
unless a particular provision is prescribed for it in the legislation related to the disciplinary
regulations at the Health Authority, disciplinary penalties shall be applied for violating the
provisions of this Resolution, in accordance with the following Laws:
1. With regard to private health facilities, the disciplinary penalties prescribed by Federal Law
No. (4) of 2015 on Private Health Facilities shall be applied;
2. With regard to physicians practicing the profession in private health facilities, the disciplinary
penalties prescribed by Federal Law No. (5) of 2019 on the Practice of Human Medicine
Profession shall be applied in;
3. With regard to the practice of health professions by non-doctors and non-pharmacists in private
health facilities, the disciplinary penalties prescribed by Federal Law No. (5) of 1984 on the
Practice of Health Professions by Non-Doctors and Non-Pharmacists shall be applied;
4. With regard to pharmacists and pharmacist assistants, the provisions of Federal Law No. (4)
of 1983 on the Profession of Pharmacy and Pharmaceutical Institutions shall be applied;
5. With regard to the profession practitioners in Health Authorities, the disciplinary regulations
applicable in these authorities shall be applied in a manner that does not contradict the
provisions of the Decree-Law and this Resolution;
6. With regard to the profession practitioners in the federal government, the provisions of Federal
Decree-Law No. (11) of 2008 on Human Resources in the Federal Government shall be
applied.
Article (19)
Cabinet Resolution No. (33) of 2009 Regarding the Executive Regulations of Federal Law No.
(10) of 2008 on Medical Liability shall be abrogated, and any provision that contradicts or conflicts
with the provisions of this Resolution shall also be canceled.
Article (20)
The Minister shall issue the necessary decisions to implement the provisions of this Resolution.
Article (21)
This Resolution shall be published in the Official Gazette and shall come into force in the next day
following the date of its publication.
